Last week I spoke to 70 members of local women’s group about how they could potentially use iPhone’s and iPad’s in useful ways in their lives as retirees. As I made a list of apps and use cases for my presentation I thought about how much I’d miss my iPhone if I were forced to give it up, and remembered a story that my father used to tell about a Yankee Clock Peddler. The story goes like this…

The Yankee Clock Peddler and his travelling companion start out on a sales tip in a rural area, and they stop for the night at a farmer’s house. In the morning before leaving to make sales call in neighbouring communities, the clock peddler asks the farmer if he’d store a clock for him for a couple of weeks, and that he’ll pick the clock up on his way back home. The farmer agreed to this, so the Peddler wound up the clock and placed it on the farmer’s wall before leaving (the farmer does not yet own a clock). When out of ear shot, the traveling companion asks the clock peddler why he left the clock at the house. Didn’t he want to sell the clock on the trip? To this the Yankee Clock Peddler replied, “don’t worry, by the time I come back in a couple of weeks, the clock will be sold… the farmer will happily buy it from me.”

The moral of the story is: “We can do without any article of luxury we have never had, but when once obtained, it is not in human nature to surrender it voluntarily.”

Here are some of the ways my iPhone is an article of luxury that I could not easily do without anymore:

I consume almost all my news on my iPhone and to a lesser extend on my iPad. I start my day reading the news in bed on my iPhone. This way I can be up to speed on the news before heading out for the day, and I don’t wake my wife before she needs to get up at the same time. For reading new I use the built-in Safari web browser, Zite and Flipboard. Sports with ESPN sports.

The other thing I do before getting out of bed (and at other times during the day) is skim through my email in the Gmail app, as well as my to-do list in GoTasks (GoTasks hooks into my Google Task list).

As I get ready to leave for work in the morning I check out the built-in Weather app so see what I’m facing weather wise before getting on my bike.

Before leaving campus around 5pm, I download the 6pm CBC news (from an earlier East coast broadcast) and then listen to it on the way home in the Downcast app at double speed. Why at double speed to you ask? Because my bike ride home only takes 15 minutes, so at double speed I can listen to the whole 30 minute news cast on my commute home. I also listen to a lot of technology podcasts for news and continuing education.

My iPhone also comes in handy for:

Settling bets. If there is disagreement over any obscure facts over dinner or in a conversation, it’s nice to know that it can settle the argument in 30 seconds with my iPhone and Siri or Google.

I frequently read books in bed, over lunch, or if I have some idle time. Kindle, iBooks are my favourite readers (Kindle ebooks tend to be less expensive in my experience). The place in the book you’re reading syncs nicely between iPads and iPhones, so you don’t have to keep track of where you are if you read on both devices. I love being able to easily change the font size to match how tired my eyes are at any given time. I think the changeable font size will be a big selling feature for older readers.

Lastly, I love to be able to share photos with family and friends when I’m out and about, rather than take time to upload them to Facebook from my computer when I get home.

I’d argue that one modern-day incarnation of the Yankee Clock Pedder’s windup wall clock is the iPhone. Once you’ve had a chance to use used an iPhone for a while, you’ll probably end up wondering how you did without it. I’m confident that would be the case for the intrepid retired women I talked to last week.

This past Friday while I playing in goal for the first time for my men’s O40 soccer team I realized how profound and long lasting muscle memory is. Early in the game when it came time for me to make my first drop kick, I did a high arching, and not very long kick that reminded me very much of the “up and under” hospital kicks that I used to do as a full back for my Jr. High rugby team. When I tried to lower the elevation of my next drop kick, my timing was off and did a relatively short line drive to a member of the opposing team (one of the worst things a goalie can do when drop kicking the ball). I went back and for the rest of the evening executing beautiful up and under rugby kick, and failing miserably when trying to get more distance out of my kicks. Looks like I need to spend some time on the field with one or more of my kids practicing my “long” drop kicks.

The other aspect of goal keeping that felt very familiar to me was the diving after shots on net. I didn’t expect that to be something that would come easily to me, but once I was between the posts, and people started shooting at me, It reminded me an awful lot like defending against someone spiking a ball at you in a volleyball game. There are obvious differences, by much of the basic technique is similar. fortunately grabbing the ball or pushing it clear of the net is easier than trying to pop the ball up in the air for a volleyball setter.

In any case I’ll be happy to play in net as long as our regular goalie is out recuperating from an injury. Playing is net is less scary and a lot more fun than I thought it would be!

I’m often asked by people who have just purchased a new iPhone or iPad what apps they should get for their new device. Right now this is what I’m recommending:

Kindle & iBooks – The Kindle and iBooks readers are the only apps you’ll probably need for reading books, and PDF files that people email to you. Both Do are excellent eBook readers, but books typically cost less in the Kindle store. On the other hand, I’ve found it much easier to get PDF files into the iBooks reader, so you’ll want to have both installed on your device. Don’t waste your time on the Kobo reader.

Zite & Flipboard - Zite is a free personalized magazine for your iPad that automatically learns what you like and gets smarter every time you use it. Flipboard on the other hand had a little bit slicker interface than Zite, but it does not learn your likes and dislikes as you read over time, but stick with the sites and categories you’ve chosen to read. I’d try both out to see which you like better.

Facebook & Path - Almost everyone is on Facebook now, and if you are, you should install the Facebook app. The user experience using the app is much more responsive and polished than the mobile web browser interface. You might also want to try out Path. Path allows you to post through to Facebook if you choose, or limit your posts to other Path users. If you try it, I suspect you’ll like it.

Evernote - An excellent tool for capturing, syncing data between your desktop and cell phone. I love the ability it gives me to take a picture of a white board, and then later do a key word search on the text that Evernote has OCR’ed for me. I like to call it my “external brain”.

DropBox – DropBox, combined with Document to Go Premium is a great solution for those who want to be able to edit MS Office documents on their mobile device, and have those files automatically sync back to their desktop or laptop computer. See my previous Blog post for more details.

Documents To Go Premium ($17) – Open & edit Word, Excel & PowerPoint Documents from all the most popular cloud sources: Google Docs, DropBox, Box.net & SugarSync.

Notability ($1) – An excellent tool for taking notes, that also allows you to record audio and sync it with your notes as you take them, as well as import and annotate PDF files.

Gmail – If you use Gmail, you’re punishing yourself by not downloading the Gmail app for your iPhone and/or iPad. The Apple mail app is ok, but you’ll be much more comfortable in the native Gmail app.

GoTasks – I use the task manager built into Gmail, so this free app has been very helpful in giving me a elegant app interface into those tasks. I actually prefer GoTasks to the native Google interface.

You can start listening to a podcast as soon as it starts downloading rather than be forced to wait until it’s finished downloading. 4.

The short answer is no… unless you earn less than $50,000 per year, a pay raise won’t make you happier. Once your basic needs are met, earning more money will not make you any happier.

Will becoming more attractive make you happier? Nope… plastic surgery or weight loss will give you an initial boost, but you get used to your new looks pretty quickly, and in the long run you won’t be any happier.

Will better health make you happier? Counter intuitively, no. Unless you’re at death’s door, you get used to your state of health, and being less or more healthy doen’t change your happiness level in the long run.

Will moving to a sunny warm city make you happer? Again, no. After the new car smell wears off, your level of happiness will move back to where it was when you were living in a cold northern city.

So, what are some things that make us happier?

Connect… with family, friend and neighbours is the most important thing you can do to contribute to your overall happiness. The good news is that this will cost you little or no money to do!

Be Active. Walk, run, bike, play games, play sports, dance yoga… these are all things that will improve your mood, especially if you’re in a bad one.

Take Notice of the beauty in nature and in life.

Keep Learning. Whether it’s new hobbies or a new skill at work. Be challenged and remember that most happiness comes in striving for goals, not in reaching them.

Give. Do something nice. Join a community. Be selfless.

If you’d like to read more on this topic, I highly recommend reading Jonathan Haidt book, The Happiness Hypothesis, or if you’d like to read great eight page summary, you can read my brother Bob McCue’s book review.

Finally, here is Dan Gilbert’s entertaining TED Talk with his take on happiness. Enjoy!

No matter what you think of Al Gore’s politics, his latest book, “Our Choice” points toward the direction that authors and publishers should be heading. Text combined with images, video and interactive graphics, make this e-Book a much more compelling product than a the equivalent physical book. I personally enjoy reading on my iPad, but all of the books I read in my Kindle reader are identical to the print copy (except that I can change the font size, and have a built in dictionary). The price is also right: $5 for the e-Book compared to $17 for the a physical copy.

My first reaction to the Our Choice app (for iPad and iPhone only at the moment) was that it reminded me a lot of CD Rom products from the 1990′s. Call me crazy, but I loved the Microsoft Encarta Encyclopedia because it not only included text and pictures, but added videos and interactive charts. I enjoyed the media rich CD Rom products that came of of the mid 1990 confluence of CD Roms, color monitors and speakers all shipping standard with PC’s.

So what is different this time around? For starters the form factor of the iPad make for a much more pleasant reading experience than sitting in front of a computer screen. In addition, the navigation interface that the iPad’s touch screen makes possible is intuitive and natural. Push Pop Press is the company that wrote the software for the book, and from what they’ve said, they hope to make their tools available so that others can publish media rich tools. Watch the video below to see how the “book” works

It was a wonderful experience reading Our Choice. Not all books, especially novels, need videos and interactive charts, but for some books (like school text books in particular) these bells and whistles make a huge positive difference. I hope to see more book in a similar format in the near future.

Serious Tools

Evernote – Cost: Free or $5 / month – An excellent tool for capturing, syncing data between your desktop and cell phone. I love the ability it gives me to take a picture of a white board, and then later do a key word search on the text that Evernote has OCR’ed for me. – http://evernote.com

Google Mobile App – Free – The app’s easy-to-use voice or image search feature locates what you are looking for without typing. Try an image search with Book or DVD covers, bar codes or house hold items. Google Goggles is a useful and fun tool. – http://www.google.com/mobile/google-mobile-app/

Dragon Dictation – Free – Speech to text app that allows you to easily speak and instantly see your text content for everything from email messages, SMS, Facebook or blog posts – http://www.dragonmobileapps.com/

Read it Later – Cost: Free – Allows you to bookmark interesting news stories on your desktop computer and then read those articles on your iPhone when you have a spare minute or two. It re-formats pages to make them easier to read on a small screen. – http://readitlaterlist.com

myHomework – Free – Allows you to keep track of you homework, classes, projects and tests. If you need help staying organized this may be a useful tool for you. A great way to get your mom to stop nagging you about your homework. – http://myhomework.rigoneri.com/

Wunderlist – Free – To Do list for iPhone, iPod Touch, Mac & Windows. An excellent generic GTD or Getting Things Done tool. iPhone/iPod Touch, Mac & Windows applications. – http://www.6wunderkinder.com/wunderlist/

Mind Maps – Cost: Free or $7 – Turns your iPhone into a brainstorming, idea collection and thought structuring device – http://simpleapps.eu/simplemind

iBooks – Free – a free ebook reader from Apple that allows you to read PDF files, and free ePub files from the internet. You can also purchase popular copyrighted books from Apple. – http://www.apple.com/ipad/features/ibooks.html

YouTube – Free – Your teacher can’t explain something to you so that you can understand? Try searching for the topic on YouTube and see if there is someone who can give you a good explanation. More often that not, you’ll find a master teacher that has taken the time to record a video for you. – http://youtube.com

Google Docs – Free – Google Docshas real time collaboration capabilities, with built in version control, and all you need is a web browser. If I was back in school, this would be the only tool I’d use for group projects. – http://docs.google.com

Fun & Useful Tools: They won’t necessarily help you with your school work, but they are cool none the less.

StarWalk – Cost: $3 – Tilt your iPhone towards the sky to and the image on your screen will correspond to the area of the sky you are pointing your phone towards.
Run keeper – Cost: Free or $10 – A great tool that maps your runs for you via GPS. The integration between the mobile app and their website is outstanding. – http://runkeeper.com

Someone asked with a new iPad asked me today for my top 5 iPad apps. I had a hard time limiting it to 5, so below are my top 7 iPad apps. There are a few apps that I love and use all the time on my iPhone, that I do not use on my iPad. This is typically because the website experience on the iPad is just as good or better than the iPad app. For example, I do not miss the Facebook app on my iPad, because the website experience is just fine on the iPad, as opposed to the sub par Facebook website experience on my iPhone.

That said, here are my current crop of favourite iPad apps:

Kindle Reader (free) – Amazon’s eBook reader has the biggest selection of current books at the moment. I have read close to 10 books on my iPad and love it as an eBook reader. I appreciate the ability to re-size the font size, look-up words instantly with it’s built in dictionary, and sync my furthest read location to my iPhone. That said, there are a number of books that I cannot buy in digital format (are you listening W.W. Norton & Co, publisher of Patrick O’Brian’s Aubrey/Maturin novels?).

Flipboard (free) – “A personalized social magazine.” It is the easiest and most user friendly way to browse your twitter feed (if you have one), or browse the online version of the Economist magazine for example. In addition you can see the twitter comments that people have made about the articles. This is a difficult app to explain, but once you’ve used it you’ll love it.

Air Video ($2.99) – If you already have a video on your desktop computer, but you don’t want to have to spend the time and effort into converting it into an iPad friendly format, Air Video allows you to simultaneously trans-code and stream the video to your iPad or iPhone over your wifi network. This works wonderfully when you’re at home, but will not work when you’re on the road. Even so, Air Video is a app I use on a weekly basis.

Read It Later (free) – Similar to Instapaper ($4.99), Read It Later allows you to bookmark articles that you’d like to read later while browsing news on your PC, Mac, iPad or iPhone, and then download those articles to read later on your iPad or iPhone. In the case of the iPhone, it re-formats the article so that it can be easily read on a small screen.

Kayak (free) – If you’re looking to travel, Kayak is a great tool to see what flights are available at what price. It’s hard to explain how pleasant the software is to use. I’ve found myself using Kayak at times even when I’m not traveling just to see how much it would cost to travel to Brazil, “just in case” I was able to go. In this case the iPad software is much nicer to use than the Kayak website. Even if you don’t end up purchasing your ticket through Kayak, it’s a nice place to start your travel plans.

Navionics Marine: Costal B.C. ($29.99) – If you are a sailer or boater with an iPad 3G or iPhone, Navionics Marine software is a must buy! The iPhone version of this charting application costs only $9.99, and it is well worth the money. I wish I had the 3G version of the iPad with it’s built in GPS hardware so I could use this software on my iPad as well as my iPhone. Not only does the software track your cruises, but gives you access to tide and current information. Once your done on the water, you can upload your cruise track to Facebook.

iBook (free) – Apple’s ebook reader is very similar to the Kindle software, except that the book selection for purchase is much smaller, but you do have the ability to view PDF documents and ePub books in iBook. I use both the Kindle Reader and iBook depending on what I’m reading.

Adobe Ideas (free) – Want to draw a quick sketch or doodle? Adobe Ideas is the app for you. Even if you can’t draw, you can always import a picture, and then trace it before exporting the drawing. Fun and functional.

The Economist (free) – I love reading the economist, but having it on my iPad makes it much easier and convenient to read. It also allows me to listen to the stories if I don’t feel like reading them.

A couple of days ago, I ran across an insightful iPad review by Anne Kirschner, a dean at City University of NY. Her iPad experience closely matches mine. Here are some of my thoughts:

The move from the morning paper to reviewing the news on the iPad, make breakfast a much more pleasant experience, because of the smaller and more easily managed iPad form factor. I actually do a lot of my “newspaper” reading in bed now.

When used in meetings, it gives you the ability to take electronic notes and consult the web for meeting related material, with out “barricading yourself behind a screen.” For me this has made a huge difference, especially now that the novelty of the iPad is wearing off and more people have them in meetings.

When traveling, it’s 10 hour battery life makes long flights more endurable as I can watch movies I really want to watch, or play games while in the air.

The 10 hour battery life means that I don’t need to recharge it during the day, and often I go 3 or 4 days between charging.

Reading using the Kindle reader is a joy. I especially appreciate being able to go back and forth between my iPad and iPod and the Kindle app knowing where I left off on the other device (this work across all Kindle apps and devices).

What I’m hoping gets fixed in version 4 of the iPad OS:

One of the main drawbacks is it’s limited ability to multi-task that we’ve become accustomed to on laptops. Copy and pasting text or an image from a web page just takes a lot longer.

One other drawback is the iPad’s current inability to sync files from your desktop computer, or from some cloud based system. If I could have 2 way syncing of some of my DropBox floders I would be a very happy man.

This is not a big issue, but I’d love to be able to output the contents of the screen via the Apple VGA dongle, from every application, not just Keynote.

That’s it for know… You should really read Anne’s article for all the interesting details she includes.

In short, yes. If you quickly want to see how much information on Facebook you are making public, go to the ReclaimPrivacy.org website, and follow the easy instructions there, and you’ll know in less than a minute how much of your information on Facebook is now available for the general public to view.

We should be concerned about how Facebook is handling information that we assumed would be private when we signed up. The problem isn’t so much that some of the information we put on Facebook is available to the public, it is that Facebook has repeatedly changed the default rules on what it makes public. When I signed up on Facebook 2 or 3 years ago, virtually all the information I posted there was private by default. That was one of the big selling points of the site: Connect with friends and share information in a private fourm.

If I signed up today, virtually all the information I post would be public by default. Not only that, but if I clicked “OK” on the different “information dialog boxes” that appeared over the past year telling me how the Facebook’s default privacy setting were changing, virtually all my information would be public now as well. That is very concerning.

To find out what you’re exposing to the public internet, go to: http://www.reclaimprivacy.org/

A couple of years ago I wrote a blog post about how to create a family friendly internet setup in your home. Given how quickly technology changes, I thought it was time to revisit the topic to see what has changed.

Being the father of five children under the age of 15 years old, and having 4 computers in our home along with a couple of iPod Touches, I’ve been experimenting with software & services over the past few years to try make my childrens’ experience on the internet as porn free as possible. After trying some commercial software for content filtering that ended up slowing down our 4 year old computer, and didn’t do anything to help on our iPod Touches, I have found something that works quite well on all the internet devices in our house (remember that no solution is 100% perfect not matter what the software vendor claims). It not only works well, but once you set it up on your home router, you don’t need to install anything on the desktop computers or iPod Touches!

OpenDNS is the solution. OpenDNS allows you to filter web content and block adult websites on the internet by simply changing the DNS servers that your computers uses, or even better by change the DNS servers on your internet router. The service not only works well, but is free to use. After you’ve setup an account you can specify the kinds of web sites you want to block. Types of sites you can filter range from, Pronography, to simply Tasteless site. You have all the control that you could ask for.

If you want, you can also enable logging so that you can keep track of the websites computers in your house are visiting. This all happens transparently, without having to install any software on your computer. If you have an internet router, you can manually change the DNS servers that your router uses to the two OpenDNS servers, and all the comptuers in hour home will automatically be protected from the kinds of web sites you specify, log the sites they visit (you have to turn the logging on, it is off by default). If you want to change your DNS settings now just use the following:

208.67.222.222

208.67.220.220

You should also install the OpenDNS client on your computers, just in case the IP address on your router changes. If your IP address changes (which happens from time to time), the OpenDNS client will let their servers know, so that your network will continue to filter content as you requested. Here is download page for the Mac and Windows clients.

While this is a great technological solution, don’t forget that you should talk to your kids about their use of the internet, and what they should do if they accidentally get on a site that they aren’t comfortable viewing (i.e. tell mom or dad so that they can take care of it). Like I said earlier, no solution is 100% effective, so chances are that they will occasionally see sites that aren’t appropriate. Making sure that they know that it isn’t their fault and that you’ll help them is probably the best way to resolve the immediate problem, and open up a dialog between you and your child on their use of the internet.

To sum up: OpenDNS along with Online Backup Software are two services that every home should seriously consider using. OpenDNS is completely free, and Online Backup Software is free up to 2GB of data backed up, and about $5 per month for unlimited backups. Enjoy!

“How can I save a YouTube file and save play it on my kids iPod on our next 12 hour road trip?” Believe it or not, this is a question that I get fairly frequently as systems administrator at the UVic Law Library, and as the neighbourhood technology guru. Here are a couple of tools that can make downloading flash videos from YouTube (or other video websites), a fairly easy task:

Step 1: Open Firefox, and download the Video Download Helper plug-in. This plugin will allow you to save Flash Files to your desktop. If that is allow you want to do, then you should be able to view the video using a video player like VLC Player. If you want to convert the flash video into something playable on your iPhone or iPod, then on to the next step.

Step 2: If you are running Windows and want to convert the flash video to an iPhone compatible format, or Windows media format, then I’d suggest you download and install Format Factory. If you are running Mac OSX, then I’d download Handbrake, to do the conversion job.

DVD Conversion: If all you want to do convert some DVD’s to iPhone or iPod Touch format for the road trip, then install Handbrake on your computer and rip the DVD’s into MP4 files. This will take a while to convert the videos (almost as long as it would take to watch the video itself), but can be worth while if everyone is able to keep their sanity on the trip.

Have fun converting YouTube videos for your kids iPods for that next long family road trip!

We know that their motto is “Do no Evil”, but now that they are a public company, their only real duty as a corporation is to enhance shareholder value. If down the road Google falls on leaner times, and they have to choose between enhancing shareholder value and protecting the public’s privacy, I’m not sure how well our privacy will be protected. I hope that they’ll do the right thing, but without strong regulation and threat of serious penalties, I’m not sure that who ever is in charge of running Google at that point in time will do the right thing.

Here’s a couple of great lines from the article:

Responding to recent public outcries over its handling of private data, search giant Google offered a wide-ranging and eerily well-informed apology to its millions of users Monday.

“We would like to extend our deepest apologies to each and every one of you,” announced CEO Eric Schmidt, speaking from the company’s Googleplex headquarters. “Clearly there have been some privacy concerns as of late, and judging by some of the search terms we’ve seen, along with the tens of thousands of personal e-mail exchanges and Google Chat conversations we’ve carefully examined, it looks as though it might be a while before we regain your trust.”

Google expressed regret to some of its third-generation Irish-American users on Smithwood between Barlow and Lake.

Added Schmidt, “Whether you’re Michael Paulson who lives at 3425 Longview Terrace and makes $86,400 a year, or Jessica Goldblatt from Lynnwood, WA, who already has well-established trust issues, we at Google would just like to say how very, truly sorry we are.”

GoAnimate.com is an entertainment website that enables the simple creation of unique computer animated stories, satires and sentiments that can be shared with the entire online community.

Historically, the creation of animation required specific skills, limiting those who can express their creativity. We designed the Go!Animate application to allow users to create animations without drawing talent or a technical understanding of advanced software such as Flash. The site provides users with a library of interesting characters, backgrounds, props, sound effects and music for use in creating their own unique animations. Creators can customize their animations with a number of tools and features that allow them to create truly unique works of expression.

Enjoy!

Last night our family watched a StarGate SG-1 episode for our family home evening activity. The episode we watched is called “New Ground” from season three. I saw it for the first time back in 2000, and I can still remember being uncomfortable watching it because of the cognitive dissonance it produced for me. Just for the record, the kids loved watching it, and we had a great discussion afterwords.

The story highlights the potential for conflict between scientific discovery and dogmatic faith, and does so in an interesting and compelling fashion. For anyone with kids or teenagers, I highly recommend watching this episode with them.

The basic plot line is this: The StarGate team travels to a new planet, where a star gate has been recently uncovered by local archaeologists in their country of Bedrosia. The archaeologists are very surprised to find a star gate, because they were actually searching for evidence that star gates did not exist. Bedrosia is at war with a rival country, the Optricians, over their beliefs regarding the origin of human life on their world. The Optricians believe that aliens brought humans to their world thousands of years ago through a portal, while the Bedrosians believe that their god, Nefertum, created life on their planet.

One of the archaeologists is convinced that the functioning star gate is dramatic proof that his own beliefs, and the beliefs of all Bedrosia, are wrong, and that the Optricians have been right all along. The Bedrosian military is not convinced by the evidence and believe that the StarGate and SG Team are all part of an elaborate hoax setup by the Optricians to undermine Bedrosian institutions and their faith (i.e. their religion). From the Bedrosian General (I’m paraphrasing): “I will not allow this hoax to undermine the institutions and faith of our people. I have read the book of Nefertum from cover to cover and know that it is true no matter what lies the Optricians try to make us believe. Our solders have not died in vain.”

“The primary theme of the episode is the ideological war between religion and science. The archaeologist is a true scientist, who has no unfounded allegiance to abstract belief, but is eager to change what he believes when presented with new evidence. The Bedrosians are dedicated to their faith, and are presented as arrogant and stubborn — unwilling to consider that their beliefs might be wrong, even when presented with hard evidence. This dichotomy is manifested in the characters of the archaeologist and the military general.” – http://www.gateworld.net/sg1/s3/319.shtml

Here are a few of “cartoons” that I created with Comic Life… It was a great was to remember a fun trip to Moab I had with my boys and Mitch Massey and his boys:

Prime Minister Harper,

I have voted for the Conservative party my whole adult life, so I hope the rumours that my party is about to introduce a version of the DMCA in Canada is not true. I work in at the University of Victoria Library, so I know how important fair use is for creativity to flourish.

DRM systems do little to protect intellectual property right holders works, and criminalize fair use behavior that most people would consider reasonable. Most people are honest, and want to pay for the digital content they use. DRM makes those digital harder to transfer between devices, and encourages people to look for non illegal non DRM sources for digital content.

Thank-you for your time.

If you are not a geek, you probably have no idea what the head line for this blog post means. If I were a citizen of the United States, living in the US, I would have just broken the Digital Millennium Copyright Act (DMCA) by simply having posted the following jumble of numbers and letters:

09 f9 11 02 9d 74 e3 5b d8 41 56 c5 63 56 88 c0

Why you ask… Well, that jumble of letters and numbers is the hexadecimal key needed to decrypt and watch the new HD DVDs. According to US law, because I am publishing information that could help someone circumvent copy protection software, I am breaking the DMCA. The knowledge and software tools to break the copy protection of regular DVDs has been widely known for some time now.

So why would I want to circumvent the copy protection of a HD DVD, or a DVD for that matter… unless I were a criminal wanting to steal the contents of the DVD? There are a number of reasons why:

If I want to play a HD DVD on my laptop, there is currently no way to do it unless I circumvent the copy protection and copy the contents of the DVD on to my laptop. Currently there are very few laptops with HD DVD drives.

If I want to play a HD DVD on my Linux computers at home I will have to circumvent the copy protection. There are no legal HD DVD players for Linux. If I want to play a HD DVD on my Linux computers I will have to use “illegal” software to do so (using the above key).

If I want to play a HD DVD on my iPod I will have to circumvent the copy protection to do so.

If I wanted to take a small piece of video to play as part of a class presentation (which is perfectly legal under the fair use doctrine in copyright law) I would have to break the DMCA in order to capture that little bit of video.

The copy protection built into HD DVDs severely limits how and where I can watch the movies. In the case of the iPod, I could pay for another version of the movie so I would watch it on my iPod, but I don’t really want to pay double just to watch the movie on another device. Buying multiple copies of the same movie would make the Movie Picture Association of America (MPAA) happy though; and richer. Somehow I think greed and the buying of politicians votes are part of this long and sordid story.

In any case, once the hex key had been discovered (The person who cracked the key said he did so in order to watch movies on his laptop), someone posted the key to the Digg.com social web site. Shortly after, Digg received a DMCA take down notice from lawyers representing the group who created the HD DVD encryption technology. Digg took down the posting, but it was immediately posted again, and promoted to the home page. Digg tried to take down all the postings, but by Tuesday evening they had given up. Every single page promoted to the home page of the web site had the offending key in the posting. Kevin Rose, the founder of Digg, wrote on his blog:

After seeing the hundreds of stories and reading thousands of comments, you’ve made it clear. You’d rather see Digg go down fighting than bow down to a bigger company. We hear you and effective immediately we won’t delete stories or comments containing the code and will deal with whatever the consequences might be. If we lose, then what the hell, at least we died trying.

Kevin and the Digg community know how moronic and unfair the Movie industry is behaving. Real criminals will not be stopped by the DMCA or copy protection. They only hurt people who want to have some choice in how they consume their digital content.

Canada does not yet have an equivalent to the DMCA, but it looks like it might be coming. Michael Geist, a law professor, talks about the “Canadian DMCA” which will probably be introduced in Parliament this spring, in the guise of copyright reform. Write your federal politician, and let’s make sure we don’t get our own version of a very bad law.
